www.jyvks.com.cn,二1967年,鉴于保护公民免于政府机构滥用权力的传统议会渠道已经不合时宜,英国议会设立了申诉专员(英文ombudsman,也称监察员、议会行政专员、巡视官等),其职责是调查和救济那些受中央政府“弊政造成的不正义”侵害的公民个人与团体的投诉。DecreeoftheStateCouncilofthePeople'sRepublicofChinaNo.431RegulationsonLettersandVisits,adoptedatthe76thExecutiveMeetingoftheStateCouncilonJanuary5,2005,areherebypromulgatedandshallbeeffectiveasofMay1,2005.PremierWenJiabaoJanuary10,2005RegulationsonLettersandVisits(Adoptedatthe76thExecutiveMeetingoftheStateCouncilonJanuary5,2005,promulgatedbyDecreeNo.431oftheStateCouncilofthePeople'sRepublicofChinaonJanuary10,andeffectiveasofMay1,2005)ChapterIGeneralProvisionsArticle1TheseRegulationsareformulatedforthepurposesofenhancingrelationsbetweenthepeople'sgovernmentsatalllevelsandthepeople,protectingthelawfulrightsandinterestsofletter-writersandvisitors,andmaintainingagoodorderinletter-writingandvisiting.Article2Theterm"lettersandvisits"intheseRegulationsmeansthatcitizens,legalpersonsorotherorganizationsgiveinformation,makecommentsorsuggestionsorlodgecomplaintstothepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelthroughcorrespondence,E-mails,faxes,phonecalls,visits,andsoon,whicharedealtwithbytherelevantadministrativedepartmentsaccordingtolaw.Acitizen,legalpersonoranyotherorganizationthatgivesinformation,makescommentsorsuggestionsorlodgescomplaintsbysuchmeansasprescribedintheprecedingparagraphisdefinedasaletter-writerorvisitor.Article3Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshalleffectivelyhandlelettersandvisitsbyconscientiouslydealingwithletters,receivingvisitors,heedingpeople'scomments,suggestionsandcomplaintsandacceptingtheirsupervision,sothatthepeople'sinterestsarebestserved.Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallkeepfree-flowingchannelsforletter-writersandvisitorsandprovideconveniencefortheletter-writersorvisitorswhogiveinformation,makecommentsorsuggestions,orlodgecomplaintsbysuchmeansasprescribedintheseRegulations.Noorganizationorindividualmayretaliateagainstletter-writersorvisitors.Article4Theworkregardinglettersandvisitsshallbedoneundertheleadershipofthepeople'sgovernmentsatalllevelsandinadherencetotheprinciplesofterritorialjurisdiction,responsibilitiesassumedatdifferentlevels,thedepartmentinchargebeingthedepartmentresponsibleandcombinationoftheneedtosolveproblemslawfully,timelyandlocallywithpersuasion.Article5Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallmakepolicydecisionsinascientificanddemocraticmanner,performtheirdutiesaccordingtolawandpreventcontradictionsanddisputesatsourcefromleadingtolettersandvisits.Anypeople'sgovernmentatorabovethecountylevelshallestablishaworkpatternforlettersandvisitscharacterizedbyunifiedleadership,coordinationamongdifferentdepartments,overallplanningandall-roundconsideration,seekingbothtemporaryandpermanentsolution,eachassumingitsownresponsibilitiesandjoiningeffortswithothersforthecommongoal,anditshallresolvecontradictionsanddisputesinatimelymannerbyholdingjointmeetingsandsettingupamechanismformakinginvestigationandcoordinationandhandlinglettersandvisitsandaworkingsystemofsupervisioninthisrespect.Responsiblepersonsofthepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallreadlettersforimportantissuesandgivewritteninstructionsonthem,receivevisitorsforimportantissues,listentoreportsontheworkregardinglettersandvisits,andstudyandsolveoverridingproblemsinsuchwork.Article6Anypeople'sgovernmentatorabovethecountylevelshallsetupadepartmentforlettersandvisits.Therelevantdepartmentofthepeople'sgovernmentatorabovethecountylevelandthepeople'sgovernmentofthetownortownshipshall,accordingtotheprinciplesoffacilitatingworkandcreatingconvenienceforletter-writersandvisitors,respectivelyassignaunitresponsiblefortheworkregardinglettersandvisits(hereinafterreferredtoastheunitforlettersandvisits)orindividualsthespecificreasonabilityforworkinthisfield.Thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelistheadministrativedepartmentofthepeople'sgovernmentatthecorrespondinglevelwhichisresponsiblefortheworkregardinglettersandvisitsandperformsthefollowingduties:(1)toaccepttheletter-or-visitmatterpresentedbyaletter-writerorvisitor,transmitittoanotherorgan,orassignanotherorgantohandleit;(2)tohandletheletter-or-visitmatterhandedoverbythepeople'sgovernmentatahigherleveloratthecorrespondinglevel;(3)tocoordinateeffortsinhandlingimportantletter-or-visitmatters;(4)tourgeandexaminethehandlingofletter-or-visitmatters;(5)tostudyandanalyzebothlettersandvisits,conductinvestigationandstudyand,inatimelymanner,makesuggestionsonimprovingpoliciesandworktothepeople'sgovernmentatthecorrespondinglevel;and(6)toprovideguidancetootherrelevantdepartmentsofthepeople'sgovernmentatthecorrespondinglevelandthedepartmentsorunitsforlettersandvisitsofthepeople'sgovernmentsatlowerlevelsintheirworkregardinglettersandvisits.Article7Thepeople'sgovernmentsatalllevelsshallestablishandimprovetheresponsibilitysystemforlettersandvisits,andshall,instrictaccordancewiththeprovisionsoftherelevantlaws,administrativeregulationsandtheseRegulations,investigatetheindividualswhoareresponsibleformalfeasanceorderelictionofdutycommittedintheworkregardinglettersandvisitsandcirculateanoticeofthematterwithinanappropriatescope.Thepeople'sgovernmentsatalllevelsshallincorporatetheachievementsscoredintheworkregardinglettersandvisitsintotheperformanceassessmentofpublicservants.Article8Therelevantadministrativeorganorunitshallgiverewardstotheletter-writerorvisitorwho,bygivinginformationorpresentingcommentsorsuggestionsinitsletterorvisit,hasmadecontributionstothenationaleconomicandsocialdevelopment,andtotheimprovementoftheworkofStateorgansandtheprotectionofpublicinterests.Therelevantadministrativeorganshallgiverewardstotheunitorindividualthathasscoredoutstandingachievementsintheworkregardinglettersandvisits.ChapterIIChannelsforLettersandVisitsArticle9Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallmakeknowntothepublicsuchmattersasthecorrespondenceandE-mailaddresses,telephonenumbersforcomplaints,timeandplacesforreceivinglettersandvisitors,methodsofinquiringabouttheprogressandresultsoftheletter-or-visitmattershandled.Thepeople'sgovernmentsatalllevelsandtherelevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshall,attheplacesforreceivinglettersandvisitorsoratthewebsites,makeknowntothepublicthelaws,regulationsandrules,theproceduresforhandlingletter-or-visitmattersandothermattersconcerningprovisionofconveniencetoletter-writersandvisitors.Article10Thepeople'sgovernmentsatthelevelofacitydividedintodistrictsandthoseatthecountylevelandtheirrelevantdepartmentsandthepeople'sgovernmentsoftownsortownshipsshallestablishthesystemofreceptiondayonwhichtheresponsiblepersonsofadministrativeorgansreadlettersandreceivevisitors,andcoordinateeffortsinhandlingletter-or-visitmatters.Letter-writersandvisitorscanreportletter-or-visitmattersfacetofacetotheresponsiblepersonsoftheadministrativeorgansatthepublicizedreceptionplaceonthepublicizedreceptionday.Responsiblepersonsofthepeople'sgovernmentatorabovethecountylevelandoftherelevantdepartmentsofthesaidgovernmentortheindividualsdesignatedbythemmaygototheplaceswheretheletter-writersorvisitorslivetotalktothemfacetofaceandexchangeviewswiththemwithregardtotheoverridingproblemstheyhavereported.Article11ThedepartmentforlettersandvisitsoftheStateshall,bymakingfulluseoftheexistingnetworkresourcesforgovernmentalaffairsinformation,establishanationalinformationsystemforlettersandvisits,inordertoprovideconvenienceforletter-writersandvisitorstopresentletter-or-visitmattersandinquireaboutthehandlingofthelettersandvisitslocally.Thelocalpeople'sgovernmentatorabovethecountylevelshall,bymakingfulluseoftheexistingnetworkresourcesforgovernmentalaffairsinformation,establishordesignatetheinformationsystemforlettersandvisitswithinitsadministrativeareasandconnectitsinformationsystemforlettersandvisitswiththoseofthepeople'sgovernmentsathigherlevels,theirrelevantdepartmentsandthepeople'sgovernmentsatlowerlevels.Article12Thedepartmentforlettersandvisitsoranyotherrelevantdepartmentsofthepeople'sgovernmentatorabovethecountylevelshall,inatimelymanner,inputthecomplaintlodgedbyaletter-writerorvisitorintotheinformationsystemforlettersandvisits.Theletter-writerorvisitormay,onthestrengthofthecomplaintacceptancecertificateissuedbytheadministrativeorgan,gotothedepartmentforlettersandvisitsorthereceptionplaceoftherelevantdepartmentofthelocalpeople'sgovernmenttoinquireaboutthehandlingofthecomplaint.Thespecificmeasuresandproceduresthereforshallrespectivelybeformulatedbythepeople'sgovernmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Article13Inlightoftheactualneedsintheworkregardinglettersandvisits,thepeople'sgovernmentsatthelevelofacitydividedintodistrictsandthoseatthecountylevelmayestablishaworkingmechanisminwhichthegovernmentplaystheleadingroleandallsectorsofsocietytakepartandwhichfacilitatesrapidsettlementofdisputes.Thedepartmentsandunitsforlettersandvisitsshallorganizetherelevantpublicorganizations,legalaidagencies,professionals,volunteersandotherstojointeffortsinhandlingcomplaintslodgedbyletter-writersandvisitorsinalawful,timelyandreasonablewaythroughadvice,education,consultation,mediation,hearing,orbyothermeans.ChapterIIIPresentingLetter-or-visitMattersArticle14Wherealetter-writerorvisitorgivesinformationormakescommentsorsuggestionsontheperformanceofdutiesbythefollowingorganizationsorindividuals,orisnotsatisfiedwiththeperformanceofdutiesbythefollowingorganizationsorindividuals,itmaypresentletter-or-visitmatterstotherelevantadministrativeorgans:(1)administrativeorgansortheirstaffmembers;(2)organizationsthatareauthorizedbylawsorregulationstoperformthefunctionsofadministrationofpublicaffairs,ortheirstaffmembers;(3)enterprisesorinstitutionsprovidingpublicservice,ortheirstaffmembers;(4)individualsinpublicorganizationsorotherenterprisesorinstitutionswhoareappointedordispatchedbyadministrativeorgansoftheState;and(5)villagers'committees,residents'committeesortheirmembers.Withregardtothecomplaintsthatshallbehandledaccordingtolawthroughlitigation,arbitration,administrativereconsiderationorotherstatutorymeans,theletter-writerorvisitorshallpresentthemtotherelevantorgansaccordingtotheproceduresasprovidedforbytherelevantlawsandadministrativeregulations.Article15Withregardtoaletter-or-visitmatterthatfallswithinthescopeofthefunctionsandpowersofthepeople'scongressesatalllevels,thestandingcommitteeofthepeople'scongressatorabovethecountylevel,thepeople'scourtorthepeople'sprocuratorate,theletter-writerorvisitorshallpresentittothepeople'scongress,itsstandingcommittee,people'scourtorpeople'sprocuratoraterespectivelyandabidebytheprovisionsofArticles16,17,18,19and20oftheseRegulations.Article16Wherealetter-writerorvisitorintendstopresentaletter-or-visitmatterthroughvisit,itshallpresenttheletter-or-visitmattertotheorganatthecorrespondinglevelorthenexthigherlevelthat,accordingtolaw,hasthepowertohandletheletter-or-visitmatter.Ifaletter-or-visitmatterhasbeenacceptedorisintheprocessofbeinghandledandtheletter-writerorvisitor,beforetheexpirationofthetimelimit,presentsthesameletter-or-visitmattertotheorganatthehigherleveloftheorganthathasacceptedandishandlingtheletter-or-visitmatter,theformershallnotaccepttheletter-or-visitmatter.Article17Aletter-writerorvisitorshall,ingeneral,presentaletter-or-visitmatterthroughcorrespondence,E-mail,faxoranyotherwrittenform.Whereitlodgesacomplaint,itshall,inaddition,stateclearlyitsname(title),address,requests,thefactsandreasons.Withregardtotheoralpresentationofacomplaint,therelevantorganshallrecordthename(title)andaddressoftheletter-writerorvisitor,itsrequests,thefactsandreasons.Article18Wherealetter-writerorvisitorwhointendstopresentaletter-or-visitmatterthroughvisit,itshallgotothereceptionplaceestablishedordesignatedbytheorganconcerned.Wheretwoormoreletter-writersorvisitorsintendtopresentthesameletter-or-visitmatterthroughvisit,theyshallchooserepresentatives,andthenumberofrepresentativesshallnotexceedfive.Article19Aletter-writerorvisitorshallbeobjectiveinpresentingletter-or-visitmatters,theletter-or-visitmatterspresentedshallbetruetofacts,anditshallberesponsibleforthetruthfulnessofthecontentsofthematerialsitprovides.Itshallnotmakeupstories,distortfacts,frameorbringafalsechargeagainstothers.Article20Letter-writersandvisitorsshall,inthecourseofwritinglettersormakingvisits,abidebylawsandregulations,shallnotharmtheinterestsoftheState,societyorthecollectiveorinfringeuponthelawfulrightsofothercitizens,shallconscientiouslymaintainpublicorderandtheorderinhandlinglettersandvisits,andshallnotcommitanyofthefollowingacts:(1)illegallyassemblingaroundofficesofStateorgansorpublicplaces,encirclingandattackingStateorgans,interceptingofficialvehicles,orjammingandobstructingtraffic;(2)carryingdangerousarticlesortoolsundercontrol;(3)humiliating,beatinguporthreateningfunctionariesofStateorgansorillegallyrestrictingotherpeople'sfreedomoftheindividual;(4)stayingandmakingtroubleatthereceptionplacesforlettersandvisits,orleavingtheindividualswhoareunabletolookafterthemselvesatsuchplaces;(5)inciting,colludingwith,coercingorenticingwithmoneyorthingsofvalueotherstowritelettersormakevisits,ormanipulatingfrombehindthescenesothersintodoingso,ortakingadvantageoflettersandvisitstoaccumulatewealth;or(6)committingotheractsthatdisruptpublicorderorimpairnationalorpublicsecurity.ChapterIVAcceptingLetter-or-visitMattersArticle21Thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelshall,uponreceivingaletterorvisit,registertheletter-or-visitmatterpresentedandhandleitonthemeritsofeachcasewithin15daysinthefollowingways:(1)Withregardtoaletter-or-visitmatterspecifiedinArticle15oftheseRegulations,notifytheletter-writerorvisitorthatitpresentssuchmattertothepeople'scongressesoritsstandingcommittee,people'scourtorpeople'sprocuratoraterespectively;andrejectthematterwhichhasbeenorshallbehandledaccordingtolawthroughlitigation,arbitration,administrativereconsiderationoranyotherstatutorymeans,whilenotifyingtheletter-writerorvisitorthatitpresentsthemattertotheorganconcernedaccordingtotheproceduresasprovidedforbytherelevantlawsoradministrativeregulations.(2)Withregardtoaletter-or-visitmatterwhichshallbehandledanddecidedonbythepeople'sgovernmentatthecorrespondinglevelorthedepartmentthereofaccordingtotheirstatutoryfunctionsandduties,transfersuchmattertotheadministrativeorganwhichhasthepowertohandleit;ormaketimelysuggestionsandsubmitsuchmattertothepeople'sgovernmentatthecorrespondinglevelfordecisionincaseofanyimportantorurgentmatter.(3)Withregardtoaletter-or-visitmatterwhichinvolvesanadministrativeorganatalowerleveloritsstaffmembers,directlytransfersuchmattertotheadministrativeorganwhichhasthepowertohandleitaccordingtotheprinciplesofterritorialjurisdiction,responsibilitiesassumedatdifferentlevels,andthedepartmentinchargebeingthedepartmentresponsible,andsendacopyofthemattertothedepartmentorunitforlettersandvisitsofthepeople'sgovernmentatthenextlowerlevel.Thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelshallnotifysuchdepartmentorunitofthepeople'sgovernmentatthenextlowerlevelofthemattertransferredregularly,andthedepartmentorunitforlettersandvisitsofthepeople'sgovernmentatalowerlevelshallreporttosuchdepartmentofthepeople'sgovernmentatthenexthigherlevelaboutthehandlingofthetransferredmatterregularly.(4)Withregardtoanyimportantmatteramongtheletter-or-visitmatterstransferredandfeedbackontheresultsofthehandlingofwhichisrequired,senditdirectlytotheadministrativeorganwhichhasthepowertohandleit,andasktheorgantofeedbacktheresultswithinthedesignatedtimelimitforhandlingitandsubmitreportsontheresultsofthehandling.Within15daysfromthedatetheletter-or-visitmatteristransferredorassignedtheretoaccordingtotheprovisionsofItems(2)to(4)oftheprecedingparagraph,theadministrativeorganconcernedshalldecidewhethertoacceptthematterandnotifytheletter-writerorvisitorofthedecisioninwriting,andinformthedepartmentorunitforlettersandvisitsofitsdecisionasrequired.Article22Withregardtoaletter-or-visitmatterwhichisdirectlypresentedtotheadministrativeorganotherthanthedepartmentsorunitforlettersandvisitsofthepeople'sgovernmentsatdifferentlevelsbyaletter-writerorvisitoraccordingtotheprovisionsoftheseRegulations,theadministrativeorganconcernedshallregistersuchmatter.Aletter-or-visitmatterthatconformstotheprovisionsofthefirstparagraphofArticle14oftheseRegulationsandfallswithinthescopeofthestatutoryfunctionsandpowersofthesaidorganshallbeacceptedbyit;anditshallnotshifttheresponsibilityontootherorgans,takeaperfunctoryattitudeordelayhandlingthematter.Ifaletter-or-visitmatterdoesnotfallwithinthescopeofthefunctionsandpowersofthesaidorgan,itshallnotifytheletter-writerorvisitorthatitpresentsthemattertotheorganwhichhasthepowertohandlethematter.Where,uponreceivingaletter-or-visitmatter,theadministrativeorganconcernedcan,onthespot,decidewhethertoacceptit,thesaidorganshalldosoinwriting.Ifsuchdecisioncannotbemadeonthespot,thesaidorganshall,within15daysfromthedateofreceiptofthematter,notifytheletter-writerorvisitorinwriting,unlessthename(title)oraddressoftheletter-writerorvisitorisunclear.Relevantadministrativeorgansshallnotifyeachotheroftheletter-or-visitmatterstheyhaveaccepted.Article23Theadministrativeorgananditsstaffmembersshallnotdivulgeortransmitthematerialsofaccusationorexposureortherelevantinformationprovidedbyaletter-writerorvisitortotheindividualordepartmentaccusedorexposed.Article24Wherealetter-or-visitmatterinvolvestwoormoreadministrativeorgans,itshallbehandledbythemthroughconsultation.Ifdisagreementarisesinhandlingofthematter,theircommonadministrativeorganatthenexthigherlevelshalldecideonwhichorganhandlesthematter.Article25Whereanadministrativeorganissplitup,mergeswithanotherorisdissolved,theletter-or-visitmattersonwhichitshallmakeadecisionshallbehandledbytheadministrativeorganwhichcontinuestoperformitsfunctionsandpowers.Ifthefunctionsanddutiesareunclear,thepeople'sgovernmentatthecorrespondinglevelortheorgandesignatedbysuchgovernmentshallhandlethematter.Article26Whenacitizen,legalpersonoranyotherorganizationdiscoversanimportantorurgentletter-or-visitmatterorinformationwhichmayexertaninfluenceonsociety,itmayreportthemattertotherelevantadministrativeorgannearby.Afterreceivingsuchreport,thelocalpeople'sgovernmentsatdifferentlevelsshallimmediatelyreporttothepeople'sgovernmentatthenexthigherleveland,ifnecessary,circulateanoticeofsuchmatteramongthecompetentdepartments.Afterreceivingthereport,therelevantdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelshallimmediatelyreporttothepeople'sgovernmentatthecorrespondinglevelandtothecompetentdepartmentatthenexthigherleveland,ifnecessary,circulateanoticeofsuchmatteramongthecompetentdepartments.Afterreceivingthereport,therelevantdepartmentoftheStateCouncilshallimmediatelyreporttotheStateCounciland,ifnecessary,circulateanoticeamongthecompetentdepartments.Theadministrativeorganshallnotconceal,giveafalsereportaboutordelayreportinganyimportantorurgentletter-or-visitmatterandinformationorinciteotherstodoso.Article27Withregardtoimportantorurgentletter-or-visitmattersandinformationwhichmayexertaninfluenceonsociety,theadministrativeorganconcernedshall,withinthescopeofitsfunctionsanddutiesandaccordingtolaw,taketimelymeasurestopreventtheoccurrenceandextensionofadverseinfluence.ChapterVHandling,andSupervisingandUrgingtheHandlingofLetter-or-visitMattersArticle28Inhandlingtheletter-or-visitmatterspresentedbyaletter-writerorvisitor,theadministrativeorgananditsstaffmembersshallperformtheirdutieswhole-heartedly,handlethemattersimpartially,ascertainthefacts,clearlydistinguishtheresponsibilities,publicizethelegalsystem,conductpersuasionandhandlethematterproperlyinatimelymanner,andtheyshallnotshifttheresponsibilityontoothers,takeaperfunctoryattitudeordelayhandlingthematters.Article29Wheretheinformationgivenbyaletter-writerorvisitororthecommentsorsuggestionsmadetherebyarebeneficialtoimprovementoftheworkoftheadministrativeorganandtopromotionofnationaleconomicandsocialdevelopment,therelevantadministrativeorganshallconscientiouslystudy,evaluateandunhesitatinglyacceptthem.Article30Thestaffmemberofanadministrativeorganwhohasadirectinterestintheletter-or-visitmatterpresentedbyaletter-writerorvisitororwiththeletter-writerorvisitorshallrecusehimself.Article31Inhandlingtheletter-or-visitmatterpresentedbyaletter-writerorvisitor,theadministrativeorganwhichhasthepowertohandlesuchmattershallheedthefactsandreasonsstatedbytheletter-writerorvisitor.Whennecessary,itmayasktheletter-writerorvisitor,ortheorganizationorindividualconcernedtogiveanexplanation;andwherefurtherverificationisneeded,itmayconductinvestigationamongotherorganizationsorindividuals.Ahearingmaybeheldforimportant,complicatedordifficultletter-or-visitmatters,andthehearingshallbeopentothepublictoascertainthefactsandclearlydistinguishtheresponsibilitiesthroughinquiry,debate,appraisalorjudgmentbyacollegiategroup.Thepeople'sgovernmentofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshallrespectivelyprescribethescopeofhearings,presidingofficer,participants,proceduresandotherthings.Article32Throughinvestigationandverification,theadministrativeorganwhichhasthepowertohandletheletter-or-visitmatterpresentedbyaletter-writerorvisitorshallmakethefollowingdecisionsaccordingtotherelevantlaws,regulations,rulesandotherprovisionsandgiveawrittenreplytotheletter-writerorvisitor:(1)tosupporttherequestifitisbasedonclearfactsandconformstolaws,regulations,rulesandotherprovisions;(2)tomakeanampleexplanationtotheletter-writerorvisitoriftherequestisreasonablebutlackslegalbasis;or(3)nottosupporttherequestifitisnotbasedonfactsordoesnotconformtolaws,regulations,rulesorotherprovisions.WheretheadministrativeorganwhichhasthepowertohandlethematterdecidestosupporttherequestaccordingtotheprovisionsofItem(1)oftheprecedingparagraph,itshallurgetherelevantorgansorunitstoexecuteitsdecision.Article33Thematterpresentedbyaletter-writerorvisitorshallbehandledwithin60daysfromthedateitisaccepted.Ifthematteriscomplicated,thetimelimitforhandlingitmaybeextendedappropriatelyupontheapprovalbytheresponsiblepersonoftheadministrativeorganconcerned,buttheperiodextendedshallnotexceed30days,andtheletter-writerorvisitorshallbenotifiedofthereasonsforsuchextension.Wherelawsoradministrativeregulationsprovideotherwise,theprovisionsthereinshallprevail.Article34Wherealetter-writerorvisitorisnotsatisfiedwiththedecisionmadebyanadministrativeorganonthehandlingoftheletter-or-visitmatter,itmay,within30daysfromthedateofreceiptofthewrittenreply,requesttheadministrativeorganatthenexthigherleveloftheoriginaladministrativeorganthathashandledthemattertoreexaminethematter.Theadministrativeorganwhichhasreceivedtherequestforreexaminationshall,within30daysfromthedateofreceiptoftherequest,makeadecisionafterreexaminationandgiveawrittenreply.Article35Wherealetter-writerorvisitorisnotsatisfiedwiththedecisionmadeafterreexamination,itmay,within30daysfromthedateofreceiptofthewrittenreply,requestforreviewfromtheadministrativeorganatthenexthigherlevelofthereexaminationorgan.Theadministrativeorganwhichhasreceivedtherequestforreviewshall,within30daysfromthedateofreceiptoftherequest,makeadecisionafterreview.Therevieworganmay,accordingtothesecondparagraphofArticle31oftheseRegulations,holdahearing,andthereviewdecisionmadethroughhearingmaybemadeknowntothepublicaccordingtolaw.Thetimeneededforhearingshallnotbecalculatedinthetimelimitprescribedintheprecedingparagraph.Wheretheletter-writerorvisitorisnotsatisfiedwiththereviewdecisionandcontinuestolodgeacomplaintonthebasisofthesamefactsandreasons,thedepartmentsorunitsforlettersandvisitsofthepeople'sgovernmentsatalllevelsandotheradministrativeorgansshallnolongeracceptthecompliant.Article36Wherethedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelfindsthatarelevantadministrativeorgancomesunderanyofthefollowingcircumstances,itshall,withoutdelay,urgesuchorgantohandlethematterconcernedandsuggestthatthesaidorganmakeimprovement,:(1)withoutjustifiablereasons,failingtohandletheletter-or-visitmatterwithintheprescribedtimelimit;(2)failingtogivefeedbackontheresultsofthehandlingoftheletter-or-visitmatterasrequired;(3)failingtohandletheletter-or-visitmatteraccordingtotheprescribedprocedures;(4)shiftingtheresponsibilityforhandlingthematterontootherdepartments,takingaperfunctoryattitude,ordelayinghandlingtheletter-or-visitmatter;(5)failingtoexecutethedecisiononthematter;or(6)needingurgingforotherreasons.Uponreceivingthesuggestionsforimprovements,theadministrativeorganshall,within30days,giveafeedbackinwritingontheimprovementsithasmade.Iftheorganrefusestoacceptthesuggestions,itshallexplainthereasons.Article37Withregardtoanypolicyproblemraisedbyaletter-writerorvisitor,thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelshallreportittothepeople'sgovernmentatthecorrespondinglevelinatimelymannerandmakesuggestionsastohowtoimprovethepolicyandsolvetheproblem.Article38Withregardtothestaffmembersofanadministrativeorganwho,intheworkregardinglettersandvisits,causeseriousconsequencesbyshiftingtheirresponsibilitiesontoothers,takingaperfunctoryattitude,delayinghandlingofmattersorpracticingfraud,thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelmaymakesuggestionstotheadministrativeorganconcernedtogivethemadministrativesanctions.Article39Thedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelshall,regularly,submitanalyticalreportsonlettersandvisitstothepeople'sgovernmentatthecorrespondinglevelwithregardtothefollowingmatters:(1)statisticaldataontheletter-or-visitmattersaccepted,theareascoveredbytheletter-or-visitmatters,andtheorgansagainstwhicharelativelylargernumberofcomplaintsarelodged;(2)informationaboutthematterswhicharetransferredforhandlingorthehandlingofwhichisurged,andthesuggestionsaboutimprovementacceptedbydifferentdepartments;and(3)thepolicysuggestionsmadeandaccepted.ChapterVILegalLiabilityArticle40Whereoneofthefollowingcircumstancesleadstothepresentationofaletter-or-visitmatter,whichcausesseriousconsequences,theindividualdirectlyinchargeandtheotherindividualsdirectlyresponsiblethereforshallbegivenanadministrativesanctionaccordingtotheprovisionsoftherelevantlawsoradministrativeregulations;iftheactconstitutesacrime,theyshallbeinvestigatedforcriminalliabilityaccordingtolaw:(1)Thelawfulrightsandinterestsofaletter-writerorvisitorareinfringeduponduetooversteppingorabuseofpower;(2)Anadministrativeorganinfringesuponthelawfulrightsandinterestsofaletter-writerorvisitorbydoingnothingaboutwhatitshalldo;(3)Thelawfulrightsandinterestsofaletter-writerorvisitorisinfringeduponduetoincorrectapplicationoflawsorregulationsorviolationofstatutoryprocedures;or(4)Theexecutionofthedecisioninsupportoftherequestofaletter-writerorvisitormadebytheadministrativeorganwhichhasthepowertohandlethematterpresentedisrefused.Article41Wherethedepartmentforlettersandvisitsofthepeople'sgovernmentatorabovethecountylevelfailstoregistertheletter-or-visitmatter,transferthemattertoanotherorganorassignanotherorgantohandlethematterasrequiredbyregulations,orfailstoperformthedutiesofsupervisingandurgingthehandlingofthematterasitshallhavedone,theadministrativeorganathigherlevelsshallorderittomakecorrections;ifseriousconsequencesarecaused,theindividualdirectlyinchargeandtheotherindividualsdirectlyresponsiblethereforshallbegivenanadministrativesanctionaccordingtolaw.Article42Wheretheadministrativeorganresponsibleforacceptingletter-or-visitmatters,inviolationoftheprovisionsoftheseRegulations,comesunderanyofthefollowingcircumstancesinacceptingaletter-or-visitmatter,theadministrativeorganatahigherlevelshallorderittomakecorrections;ifseriousconsequencesarecaused,theindividualdirectlyinchargeandtheotherindividualsdirectlyresponsiblethereforshallbegivenanadministrativesanctionaccordingtolaw:(1)failingtoregistertheletter-or-visitmatterithasreceived,asisrequiredbyregulations;(2)refusingtoaccepttheletter-or-visitmatterwhichfallswithinthescopeofitsstatutoryfunctionsandpowers;or(3)failingtoinforminwritingwithinthespecifiedtimelimittheletter-writerorvisitorofwhethertheletter-or-visitmatterisaccepted.Article43Wheretheadministrativeorganwhichhasthepowertohandleletter-or-visitmatters,inviolationoftheprovisionsoftheseRegulations,commitsanyofthefollowingactsinhandlingaletter-or-visitmatter,theadministrativeorganatahigherlevelshallorderittomakecorrections;ifseriousconsequencesarecaused,theindividualdirectlyinchargeandtheotherindividualsdirectlyresponsiblethereforshallbegivenanadministrativesanctionaccordingtolaw:(1)shiftingtheresponsibilityontoanotherorgan,takingaperfunctoryattitude,ordelayinghandlingtheletter-or-visitmatter,orfailingtowindupthehandlingoftheletter-or-visitmatterwithinthestatutorytimelimit;or(2)failingtosupporttherequestwhichisbasedonclearfactsandconformstorelevantlaws,regulations,rulesandotherprovisions.Article44Wherethestaffmemberofanadministrativeorgan,inviolationoftheprovisionsoftheseRegulations,divulgesortransmitsthematerialsofaccusationorexposureandrelevantinformationprovidedbyaletter-writerorvisitortotheindividualorunitaccusedorexposed,heshallbegivenanadministrativesanctionaccordingtolaw.Wherethestaffmemberofanadministrativeorgan,inhandlingaletter-or-visitmatter,isrudeinhisstyleofwork,thusintensifyingcontradictionsandcausingseriousconsequences,heshallbegivenanadministrativesanctionaccordingtolaw.Article45Whereanadministrativeorgananditsstaffmembers,inviolationoftheprovisionsofArticle26oftheseRegulations,conceal,makeafalsereportofordelayreportingtheimportantorurgentletter-or-visitmattersorinformatinnwhichmayexertaninfluenceonsociety,orinciteanotherindividualtodoso,thuscausingseriousconsequences,theindividualdirectlyinchargeandtheotherindividualsdirectlyresponsiblethereforshallbegivenanadministrativesanctionaccordingtolaw;iftheactconstitutesacrime,theyshallbeinvestigatedforcriminalliabilityaccordingtolaw.Article46Whoeverretaliatesagainstaletter-writerorvisitor,thusconstitutingacrime,shallbeinvestigatedforcriminalliabilityaccordingtolaw;iftheactisnotseriousenoughtoconstituteacrime,heshallbegivenanadministrativeordisciplinarysanctionaccordingtolaw.Article47Wherealetter-writerorvisitorviolatestheprovisionsofArticle18or20oftheseRegulations,thestaffmemberoftheStateorganconcernedshalldissuade,criticizeoreducatehim.Ifsuchdissuasion,criticismoreducationfails,thepublicsecurityorganshallwarnoradmonishtheletter-writerorvisitororstopitsact.Iftheletter-writerorvisitorviolatesthelawsoradministrativeregulationsonassemblies,processionsanddemonstrationsorifitsactconstitutesaviolationofpublicsecurityadministration,thepublicsecurityorganshall,accordingtolaw,takenecessarymeasurestodealwiththecaseonthespotandimposethereuponanadministrativepenaltyforpublicsecurity.Iftheactconstitutesacrime,itshallbeinvestigatedforcriminalliabilityaccordingtolaw.Article48Wherealetter-writerorvisitormakesupastoryordistortsfactsinanattempttoframeorbringafalsechargeagainstanotherindividual,whichconstitutesacrime,heshallbeinvestigatedforcriminalliabilityaccordingtolaw.Iftheactisnotseriousenoughtoconstituteacrime,thepublicsecurityorganshallimposethereuponanadministrativepenaltyforpublicsecurityaccordingtolaw.ChapterVIISupplementaryProvisionsArticle49Socialorganizations,enterprisesandinstitutionsshallhandlelettersandvisitswithreferencetotheseRegulations.Article50Theletter-or-visitmatterspresentedbyforeigners,statelessindividualsorforeignorganizationsshallbehandledwithreferencetotheseRegulations.Article51TheseRegulationsshallbeeffectiveasofMay1,2005.TheRegulationsonLettersandCallspromulgatedbytheStateCouncilonOctober28,1995shallberepealedsimultaneously.
